DARCI is a law firm dedicated to avoiding and resolving disputes in international construction projects.
Disputes are endemic in the construction industry. However, often, disputes can be avoided. Through careful contract drafting, risks can be adequately allocated to be properly managed during the construction phase. Through skilful contract management, disagreements can be resolved in real time before becoming claims and disputes. Ultimately, if disputes arise, there are tools available to resolve them efficiently and pragmatically.
Prevention is better than cure. This is particularly true in international construction projects where disputes can have significant time and cost implications, may seriously damage the parties’ relationship and can jeopardise project delivery.
From inception to completion, we assist our clients to anticipate and avoid disputes, in order to help them focus on project completion rather than claim management. Whether during the contract negotiation or execution, we provide strategic advice at every step of the project life cycle to help the parties move the project forward and preserve their business relationship.
Our goal is to reach completion dispute free. We collaborate with our clients closely to achieve this objective. If disputes arise nonetheless, we use the tools that can provide the best results in the most expeditious and cost effective manner. Principled negotiation, mediation, dispute boards and expert determination are amongst our preferred alternative dispute resolution (“ADR”) methods.
We use innovative approaches to dispute resolution by employing ADR methods alternatively and, often, in combination. We systematically explore the different options to yield the best possible outcome for our clients.
Yann Schneller is a qualified French lawyer focusing his practice on the avoidance and the resolution of disputes in international construction projects.
Yann strongly believes that most construction disputes can be avoided. He therefore assists employers and contractors on the full cycle of complex, high-value construction contracts to help the parties achieve project completion dispute free. Yann provides strategic procurement advice, contract drafting and negotiation, as well as contract management services. He assists clients in resolving disputes through alternative dispute resolution processes. He represents clients in international arbitration proceedings, both ad hoc and under the rules of major arbitration centers.
